Terms and Conditions

The terms of use for creators and supporters on suggar.me.

These Terms and Conditions govern the use of suggar.me by creators and supporters. By registering or using the payment functions, you accept these terms.

§ 1 Scope of Application and Contracting Parties

(1) These Terms and Conditions ("Terms") govern the use of the online platform suggar.me (hereinafter the "Platform"), operated by the provider named in the Legal Notice (hereinafter the "Operator").

(2) They apply to all registered creators (account holders) as well as to supporters who make payments via the Platform.

(3) Deviating terms shall not be recognized unless the Operator has expressly agreed to them in writing.

§ 2 Registration and Formation of Contract

(1) Registering as a creator constitutes a usage agreement with the Operator. There is no entitlement to registration.

(2) Only natural persons who have reached the age of 18 may register.

(3) The data provided during registration (first and last name, email, username) must be correct and up to date. Pseudonyms are permitted as a public display name.

(4) Each person may operate only one creator account. Sharing login credentials is prohibited.

(5) Registration as a creator is currently available only to natural persons with a billing address in a European Union member state. Supporters may make payments worldwide regardless of their place of residence; all payments on the Platform are processed in euros (EUR).

§ 3 Services Provided by the Operator

(1) The Operator provides creators with a customizable profile page through which supporters can make one-time payments (support) and monthly subscriptions.

(2) Payment processing is handled exclusively via Stripe, Inc. as a third-party provider through Stripe Connect. The Operator is not a payment service provider and does not process complete payment data.

(3) Minimum amount: The minimum amount for a one-time payment or a subscription is 3.00 €.

(4) Platform fee (borne by the creator): Depending on the creator's plan, a platform fee is deducted from the payout amount:

(5) Stripe transaction fees (borne by the supporter): In addition to the platform fee, separate Stripe processing fees apply. Their amount depends on the payment method chosen and the applicable terms, and they are shown to the supporter before completing payment at checkout. The creator does not bear any Stripe processing fees.

(6) There is no entitlement to uninterrupted availability of the Platform. Maintenance work will be announced whenever possible.

(7) Activation: The profile page only becomes publicly visible once Stripe verification (KYC) has been completed and the account has been approved by the Operator; until then it is not publicly viewable. The creator is notified by email of approval or rejection.

(8) Creator plan (Basic/Pro/Premium): In addition to the free Basic plan, the creator may subscribe to a paid Pro or Premium plan, which reduces the platform fee under paragraph 4 and unlocks additional features. The Pro and Premium plans are monthly subscriptions that renew automatically at the applicable price plus statutory VAT until the creator cancels or downgrades. Pro and Premium can only be purchased by creators with a billing address in an EU member state.

(9) Changing plans: An upgrade (e.g. from Basic to Pro or Premium) takes effect immediately and is charged via a new payment. Any downgrade — including a move from Premium to Pro — takes effect at the end of the current, already-paid billing period and results first in a move to the free Basic plan; a direct switch between two paid plans without an intermediate step through Basic is not possible. No pro-rata refund is given for the period already paid. Only one plan change is possible per billing period.

(10) Cancelling the creator plan: The creator may cancel their paid plan at any time in the dashboard. The cancellation takes effect at the end of the current billing period; the benefits of the cancelled plan remain available until then.

§ 4 Stripe Connect and Payouts

(1) Creators must connect a Stripe account to receive payments (Stripe Express/Standard). The contractual relationship between the creator and Stripe is governed by the Stripe Terms of Service.

(2) SUGGAR automatically initiates payout of the available balance according to the creator's plan: Basic monthly on the 1st, Pro weekly on Mondays, Premium daily. The actual transfer is made via Stripe Connect in accordance with Stripe's payout schedules (generally 2–7 business days) and may be further delayed by bank-internal or compliance checks. The Operator has no influence over these Stripe-internal review processes or delays.

(3) The Operator is not liable for damages caused by decisions made by Stripe (e.g., account suspensions, chargebacks).

§ 5 Obligations of Creators

(1) Creators undertake to publish only lawful content. In particular, the following are prohibited:

(2) Creators are solely responsible for the tax treatment of their income. The dashboard provides a transaction overview as a basis for this.

(3) Creators are liable for all third-party claims arising from their content and shall indemnify the Operator against such claims.

§ 6 Rights and Obligations of Supporters

(1) One-time payments (support) are voluntary. Unless expressly promised by the creator, they do not give rise to any entitlement to consideration in return.

(2) Subscriptions are billed monthly. Supporters may cancel their subscription at any time, effective at the end of the current billing period. Periods already billed will not be refunded.

(3) Chargebacks without a valid reason are prohibited. If a chargeback results in a negative SUGGAR balance for the affected creator (the disputed amount plus the processing fee charged by Stripe, approx. €15 per chargeback under Stripe's pricing), the account is automatically suspended until the balance is settled; active supporter subscriptions are paused rather than cancelled for the duration of the suspension, so no additional charges occur. The Operator further reserves the right to permanently block access in cases of abusive behavior.

(4) Refunds: Support payments already made and billing periods already charged are, as a rule, not refunded voluntarily. A refund is issued only where legally required or where the Operator, on a case-by-case basis, recognizes a valid payment error or duplicate charge. Refund requests can only be raised and processed by the Operator itself; neither creators nor supporters can trigger a refund themselves.

§ 7 Termination and Suspension

(1) Creators may terminate their account at any time by contacting support. Processed payments will not be reversed.

(2) The Operator may suspend accounts without prior notice for violations of these Terms or for a negative balance caused by chargebacks. A suspension takes the profile page offline and blocks new payments; any active supporter subscriptions are paused for the duration of the suspension and resume automatically once it is lifted, with no retroactive charges. In the case of serious violations, the Operator may permanently delete the account without prior notice. There is no entitlement to reinstatement.

(3) Upon termination, profile and account data will be deleted within 30 days. Transaction data will be retained for 10 years in accordance with statutory retention obligations (German Civil Code sections §§ 147 AO, 257 HGB — Abgabenordnung and Handelsgesetzbuch).

§ 8 Limitation of Liability

(1) The Operator is liable without limitation for intent and gross negligence, as well as for injury to life, body, or health.

(2) In cases of slight negligence, the Operator is liable only for breach of material contractual obligations (cardinal obligations) and limited to the typically foreseeable damage.

(3) The Operator is not liable for outages, data loss, or damages caused by third-party providers (in particular Stripe, hosting providers) to the extent these are beyond its sphere of influence.

§ 9 Intellectual Property

(1) Creators grant the Operator a simple, worldwide, royalty-free right of use to uploaded content to the extent necessary for operating the Platform (e.g., display on the profile page, thumbnail images).

(2) This right expires upon deletion of the account or the respective content. The creator warrants that they hold all necessary rights to the uploaded content.

§ 10 Changes to the Terms

The Operator reserves the right to amend these Terms. Creators will be notified of material changes by email at least 30 days before they take effect. An objection within this period shall be deemed termination of the usage agreement effective as of the date the change takes effect.

§ 11 Applicable Law and Jurisdiction

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) The place of jurisdiction for disputes with creators who are merchants or legal entities is the Operator's registered place of business.

§ 12 Consumer Dispute Resolution

We are not willing and not obligated to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).
